Doesn't effectively kill mice

I've had these traps in our home for a few months now. They're easy to bait, and trigger about the same as the typical wooden mouse trap. But I find that the traps don't actually kill the mouse, instead they just pin the poor critter by its neck while it flails in pain. I'd say i've set these traps and caught about 10 mice with them, but only 2 of the 10 mice have been killed by the trap, with the remaining 8 getting released outside or my cat got to them before I could.
Maybe the arm/spring mechanism just isn't strong enough, maybe I have oddly durable mice.
No, I do not recommend this product.
